Terms of Service

These terms govern your use of the Rigaway apps, desktop agent, websites, hosting, and cloud desktops.

Effective date: October 18, 2026. "Rigaway", "we", or "us" means Rigaway, Inc., a Delaware corporation. By creating an account or using Rigaway, you agree to these terms, our Acceptable Use Policy (which is part of these terms), and our Copyright & DMCA Policy. Our Privacy Policy explains how we handle personal data.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. If you use Rigaway on behalf of an organization, you confirm you're authorized to accept these terms for it. You sign in with a code we email you, or with Apple, Google, or GitHub. You're responsible for your account, for activity under it, and for keeping your email and sign-in accounts secure. Tell us promptly at security@rigaway.com if you suspect unauthorized access.

2. The service

Rigaway connects your phone to a computer — your own, or a cloud desktop we host for you — over an encrypted, end-to-end device-to-device connection, and offers related features: terminals, files, live preview, AI agent control, project sync, web hosting, and optional managed cloud desktops. We may change, add, or remove features over time.

Beta and preview features. Rigaway is in beta. Features labeled beta, preview, waitlist, or experimental (including cloud desktops while they roll out by waitlist) are provided as-is, may change or be discontinued, and may have lower reliability.

3. AI agents & third-party services

Rigaway lets you control AI coding agents (for example Claude Code, Codex, GitHub Copilot, or local models) that run on your computer using your own accounts with those providers. Your use of an AI provider, an app store, a domain registrar, or any third-party service or integration you connect is governed by that provider's terms and privacy policy, not ours, and we're not responsible for those services. AI output can be wrong or harmful; agents you start can read and change files and run commands on the computer they run on. You decide what agents may do, and you're responsible for reviewing their actions and output.

4. Your content

You retain all rights to your code, files, and anything you publish ("Your Content"). On Self-Hosted, your code and files stay on your own computer and are not uploaded to our servers in normal use; see the Privacy Policy. Where Your Content is on our infrastructure — a website you deploy to hosting (including its files, environment settings, database, and storage) or files on a cloud desktop — you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, cache, transmit, and display it solely to operate, secure, and provide the service to you and the visitors you choose. That license ends when you delete the content, except for copies we must keep under section 10 or for legal reasons. You're responsible for Your Content, for having the rights to it, and — if your website collects data from its visitors — for giving them any notices and obtaining any consents the law requires. Where we process personal data on your behalf in hosting or cloud desktops, our Data Processing Addendum applies and is part of these terms.

If you send us feedback or suggestions, we may use them without obligation to you.

5. Acceptable use, hosting & takedowns

Your use must comply with our Acceptable Use Policy. We don't pre-screen hosted content, but we act on reports. We may remove or disable content, suspend a website, or suspend or terminate accounts for violations, and we may preserve content when the law requires it (for example, child-safety reporting). Copyright complaints are handled under our DMCA policy, and we terminate the accounts of repeat infringers in appropriate circumstances. Anyone can report abuse.

6. Subscriptions, trials, billing & refunds

Rigaway is offered through paid subscription plans, with optional hosting add-ons (Hosting Plus and Hosting Pro). See pricing for current plans, prices, and included limits.

Purchased through the App Store or Google Play. Subscriptions are sold as in-app purchases through the Apple App Store or Google Play, which act as the merchant of record. Pricing in your currency, taxes, payment, auto-renewal, cancellation, and refunds are handled by Apple or Google under their terms and managed in your App Store or Google Play account — not by us.

Auto-renewal. Subscriptions renew automatically at the end of each billing period until you cancel. Cancel anytime in your App Store or Google Play subscription settings; you keep access through the end of the period you've paid for. Deleting your Rigaway account does not cancel a store subscription — cancel it in your store account too.

Free trial. The Self-Hosted plan may include a free trial (currently 14 days). Trial availability, eligibility, length, and when charges begin are determined by Apple or Google and shown on the purchase screen before you subscribe. Unless you cancel before the trial ends, the subscription converts to a paid subscription automatically.

Usage limits. Plans include the limits shown on the pricing page (for example cloud-desktop runtime, hosting requests, and fair-use caps). When a hosting limit is reached, affected websites pause until the next monthly period or until you upgrade — we don't charge overages. We may change prices or plans prospectively; Apple or Google will notify you of price changes as their rules require.

If we later offer web-based billing, the payment processor and its terms will be presented at purchase and added here.

7. Our software & intellectual property

Rigaway and its software, trademarks, and website content are owned by us or our licensors. Subject to these terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Rigaway apps and desktop agent to use the service. You may not reverse engineer, resell, or circumvent the service's limits or security, except where the law expressly allows. Open-source components included in our software are licensed under their own licenses, which control where they apply. The desktop agent is licensed to you under these terms.

8. Mobile app terms (Apple & Google)

If you downloaded a Rigaway app from the Apple App Store: these terms are between you and us, not Apple, and we — not Apple — are solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app. We, not Apple, are responsible for addressing any claims relating to the app or your use of it (including product liability, legal or regulatory compliance, consumer protection, and intellectual-property infringement claims). You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (such as your wireless carrier's) when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded a Rigaway app from Google Play, your use of Google Play and purchases made through it are also subject to Google Play's terms.

9. Export controls

You may not use, export, or re-export Rigaway in violation of U.S. or other applicable export-control and sanctions laws, including in embargoed countries or by prohibited persons.

10. Termination & your data

You may stop using Rigaway and delete your account anytime in the app (Settings → Account → Delete account) or by emailing privacy@rigaway.com. Deleting your account removes your account data, registered devices, and your hosted websites and their databases and storage. You can also delete a single hosted website in the app; its address is released right away. Each website keeps a limited number of recent versions for rollback (currently 5, space permitting), and older versions are deleted automatically. Hosting requires an active Self-Hosted subscription or trial: if yours ends, your websites keep running for a grace period (currently 7 days), are then paused, and if you haven't resubscribed within 30 days of it ending, they are deleted with their files and data and their addresses become available to others. We email you before that happens. If a cloud-desktop subscription ends, we keep that desktop's data for a grace period (currently 30 days) and then permanently delete it. Content on hold for a legal reason (for example a website taken down for child-safety reporting) and takedown and abuse records are kept as described in the Privacy Policy.

We may suspend or terminate access for violations of these terms or the AUP, for non-payment, to comply with law, or to protect the service or its users. Where appropriate and lawful, we'll tell you why. Sections that by their nature should survive termination (including 4, 7, and 11–16) survive.

11. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent permitted by law. We don't warrant the service will be uninterrupted, error-free, or secure, or that it will meet your requirements. You are responsible for backups of Your Content.

12. Limitation of liability

To the fullest extent permitted by law, Rigaway will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid for the service in the 12 months before the claim or USD $100. Some jurisdictions don't allow these limits, so they may not fully apply to you.

13. Indemnity

To the extent permitted by law, you'll defend and indemnify Rigaway against third-party claims arising from Your Content, your use of the service in violation of these terms, or your violation of law or anyone's rights.

14. Governing law & disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Before bringing a claim, please email legal@rigaway.com so we can try to resolve it informally within 30 days. If we can't, the claim will be decided exclusively by the state or federal courts located in Delaware, and you and we consent to their jurisdiction — except that either of us may bring an individual claim in a small-claims court that has jurisdiction. Nothing here limits consumer rights that can't be waived under your local law.

15. Changes

We may update these terms as the service evolves and will update the effective date above. For material changes we'll give at least 30 days' notice by email or in the app before they take effect. Continuing to use Rigaway after changes take effect means you accept them; if you don't agree, stop using the service and delete your account.

16. General

These terms (with the policies they reference) are the entire agreement between you and us about Rigaway. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
